This Privacy Policy outlines how Eight Elements Pty Ltd trading as SIHA [ABN 70 865 452 939] ("we", "us", "our") collects, uses, and discloses personal information.

Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive Information will be used by Us only:

(i) for the primary purpose for which it was obtained;

(ii) for a secondary purpose that is directly related to the primary purpose; and

with your consent or where required or authorised by law.

2. Use of Information

We use your information to:

By using Our Website, you consent to the receipt of direct marketing material. However, most of the Personal Information that is stored in Our client files and records will be kept for a minimum of seven years to fulfill Our record keeping obligations.

(i) permit you to obtain access to the Personal Information We hold about you in certain circumstances (APP 12); and

(ii) allow you to correct inaccurate Personal Information subject to certain exceptions (APP 13).

7. Your Rights

If you have a complaint concerning the manner in which We maintain the privacy of your Personal Information, please contact Us on the contact details set out at the bottom of this privacy policy.

(e) All complaints will be considered by Us and We may seek further information from you to clarify your concerns. If We agree that your complaint is well founded, We will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).

Depending on your jurisdiction, you may have rights to:

Access, correct, or delete your personal data.
Restrict or object to processing.
Withdraw consent.
Lodge a complaint with a regulatory authority.

8. International Transfers

Data may be transferred internationally (e.g., through Shopify). Appropriate safeguards (e.g., standard contractual clauses) are implemented.

Your Personal Information may be transferred to recipients located in countries which have data protection laws which protect Personal Information in a way which is at least substantially similar to the APP, and there will be mechanisms available to you to enforce protection of your Personal Information under that overseas law. In the circumstances, We do not require the overseas recipients to comply with the APP and We will not be liable for a breach of the APP if your Personal Information is mishandled.

Your Personal Information may be transferred to recipients located in an overseas jurisdiction with data protection laws which are not as robust as Australia's. You consent to Us transferring your Personal Information to those jurisdictions in the knowledge that if your Personal Information is mishandled in those jurisdictions, We disclaim responsibility and you will not have a remedy under Australian law.
